Terms of service

Plain terms for a measurement product. The most important clause is the one about guarantees: we measure outcomes, we do not manufacture them.

These terms cover your use of the AI Visibility Tracker platform and any managed implementation engagement. They exist mainly to make responsibilities unambiguous: what the platform measures, what it will never claim, and who owns what.

The service

The platform tracks how AI surfaces cite and characterise a brand across a set of buyer-intent prompts, computes visibility metrics from those observations, generates remediation assets, and reports on measured change over time.

AI surface answers are collected on a weekly cycle. The service is a drift detection and measurement system. It is not a real-time monitoring service and it does not guarantee continuous availability of any third-party AI surface.

Accounts and access

  • You are responsible for the accuracy of the brand details and competitor names you submit, and for keeping your credentials confidential.
  • API tokens grant read and limited write access to your brand data. Treat them as secrets; revoke any token you believe has been exposed.
  • Access is provisioned per account and per brand. Multi-brand switching within a single login is not currently supported.
  • An administrator role exists for operating the collection pipeline and is never granted to client accounts.

Acceptable use

  • Do not use the service to make defamatory, misleading or unlawful claims about a competitor.
  • Do not submit confidential information, personal data or regulated data as a tracked prompt. Prompts are sent to a third-party language model provider for extraction.
  • Do not use generated outreach drafts to impersonate a customer, conceal a commercial relationship or post undisclosed promotional content.
  • Do not attempt to circumvent rate limits, brand isolation, authentication or access controls.

What is not guaranteed

No specific visibility score, ranking, citation, mention or revenue outcome is promised. AI surface outputs are determined by third parties and change without notice. Any vendor claiming otherwise is either guessing or planning to define the metric after the fact.

What is committed to is measurement integrity: when you mark an action complete, the current score is locked as its baseline, and a measured after-value is recorded once a later complete cycle exists. Actions still awaiting a second cycle are reported as awaiting measurement rather than as a result.

Plans and billing

  • Software Intelligence is billed monthly per brand. The Managed GEO Sprint is billed monthly for the duration of the engagement.
  • Engagements open with fourteen days of full platform access. Unless cancelled within that window, billing begins at the end of it.
  • Prices are stated in US dollars and exclude applicable taxes. Fees are non-refundable for periods already served.
  • Either party may cancel with effect from the end of the current billing period. Your data remains exportable after cancellation.

Your data and generated assets

You retain ownership of the brand data you submit and of the reports produced for it. We retain ownership of the platform, its scoring model, its generated asset templates and its underlying code.

Assets generated for you — answers, llms.txt files, schema and comparison blueprints — may be published by you without restriction. Generated assets are drafts and are not professional legal, financial or compliance advice; you are responsible for verifying any factual claim before publication.

Confidentiality

Each party will keep the other party's non-public information confidential and use it only to perform under these terms. Reported metrics are confidential to you; share links are generated at your discretion and are your responsibility once issued.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or lost business opportunity, arising from these terms.

Our total aggregate liability is limited to the fees paid by you in the three months preceding the claim.

Nothing in these terms limits liability that cannot lawfully be limited.

Termination

Either party may terminate for material breach that remains uncured thirty days after written notice. We may suspend access immediately for use that threatens the security or integrity of the service, or for non-payment.

On termination, tracking stops, data becomes exportable for thirty days, and is then deleted on request or by policy.

Changes to these terms

Material changes are reflected in the last-updated date above and communicated to active accounts by email before they take effect. Continued use after the effective date constitutes acceptance.

Note: these terms are written by the engineering team to describe the service accurately. They should be reviewed by a qualified lawyer in your jurisdiction before the service is sold commercially.
